WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $7,621,389.00 for the Emergency Solutions Grant (ESG) and no adequate provision has been made in the 2020 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A: 4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, by authorizing resolution 7R1-a dated November 7, 2019 the City of Newark accepted funds for the Emergency Solutions Grant (ESG) from the U.S. Department of Housing and Urban Development (HUD) in the amount of $608,884.00 to provide emergency shelter in-place assistance to qualified applicants and their families within the City of Newark; and
WHEREAS, by the award letter dated July 28, 2020, the U.S. Department of Housing and Urban Development has amended the One Year Action Plan to increase Emergency Solutions Grant (ESG) funds by $7,621,389.00 bringing total program resources to $8,230,273.00 for said grant; and
WHEREAS, a previous resolution authorizing TE #42 and prior emergency appropriations submitted for Municipal Council approval totaled $434,694,341.78; and
WHEREAS, N.J.S.A. 40A: 4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriations adopted in 2020, pursuant to N.J.S.A. 40A: 4-20 including this resolution total…………………$442,315,730.78.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. A temporary emergency appropriation be and the same is
hereby made for the following classification.
Program Amount
Emergency Solutions Grant $7,621,389.00
(ESG) CARES Act
2. Said emergency appropriation shall be provided for in the 2020 budget.
3. A copy of this resolution shall be filed with the Director of Local Government Services by the City Clerk.
STATEMENT
This legislation authorizes and establishes the temporary appropriation for the Emergency Solutions Grant (ESG) in the amount of $7,621,389.00. The U.S. Department of Housing and Urban Development (HUD)/Coronavirus Aid, Relief and Economic Security Act (CARES Act) are awarding said funds to the City of Newark. The Project period is September 1, 2019 through August 31, 2020. (Citywide)
