        WHEREAS, all of Essex County has exposure to natural hazards that increase the risk to life, property, environment and the County’s economy; and

 

        WHEREAS, pro-active mitigation of known hazards before a disaster event can reduce or eliminate long-term risk to life and property; and

 

        WHEREAS, the County of Essex and the Essex County Sherriff’s Office of Emergency Management (Essex OEM), received a grant for pre-disaster mitigation from the Federal Emergency Management Agency (FEMA) and the New Jersey State Office of Emergency Management (NJ OEM) for the purpose of coordinating and creating an All-Hazard Mitigation Plan (the “Plan”) for Essex County and the twenty-two (22) municipalities within; and

 

        WHEREAS, the Essex County Mitigation Planning Council is a coalition of Essex County jurisdictions with like planning objectives formed to pool resources and create consistent mitigation strategies within Essex County; and

 

        WHEREAS, in an effort to address the natural hazards and remain in compliance with the Disaster Mitigation Act of 2000 (DMA 2000), the City of Newark, assisted as a member of the Essex County Mitigation Planning Council to create the county-wide mitigation plan; and

 

        WHEREAS, the DMA 2000 (Public Law 106-390) established new requirements for pre and post disaster hazard mitigation programs; and

 

        WHEREAS, the DMA 2000 requires states and local governments to prepare all hazard mitigation plans in order to remain eligible to receive public assistance, and pre and post Disaster Mitigation, Hazard Mitigation Grant Program and Flood Mitigation Assistance grant funds; and

 

       WHEREAS, the DMA 2000 regulations require that local plans be formally updated and adopted every five (5) years, reassessing their risk and updating their local strategies to manage and mitigate those risks; and

 

       WHEREAS, as a participant in the Essex County Mitigation Planning Council, representatives in the City of Newark assisted in the plan updating process that engaged the public, assessed the risk and vulnerability to the impacts of natural hazards in the City, developed a mitigation strategy consistent with a set of uniform goals and objectives, and created a plan for implementing, evaluating and revising this strategy; and

 

       WHEREAS, the Essex County Office of Emergency Management submitted the County’s Hazard Mitigation Plan to NJ OEM and FEMA that was approved in January of 2020; and

 

       WHEREAS, due to delays in processing this resolution as a result of the ongoing COVID-19 pandemic the actions authorized by this resolution are being ratified to June 1, 2020, as required by FEMA; and 

 

       WHEREAS, the City ratifies and adopts in its entirety, the 2020 Essex County All Hazard Mitigation Plan Update (the “Plan”) as the jurisdiction’s Natural Hazard Mitigation Plan, and resolves to execute the actions identified in the Plan that pertain to this jurisdiction.

 

 NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The County of Essex and the Essex County Sherriff’s Office of Emergency Management (Essex OEM) received a grant for Pre-Disaster Mitigation from The Federal Emergency Management Agency (FEMA) and the New Jersey State Office of Emergency Management (NJ OEM) for the purpose of coordinating and creating an all-hazard Mitigation Plan for Essex County and the twenty-two (22) municipalities within.

 

2.                     In an effort to address the natural hazards and remain in compliance with the Disaster Mitigation Act of 2000 (DMA 2000), the City, contributes as a member of the Essex County Mitigation Planning Council to create the county-wide Mitigation Plan in order to remain eligible to receive public assistance and pre and post disaster Mitigation, Hazard Mitigation Grant Program and Flood Mitigation Assistance grant funds.

 

3.                     The City adopts in its entirety, the 2020 Essex County All Hazard Mitigation Plan Update (the “Plan”) as the City’s Natural Hazard Mitigation Plan, and resolves to execute the actions identified in the Plan that pertain to our jurisdiction.

 

4.                     The City will use the adopted and approved portions of the Plan to guide pre and post disaster mitigation of the hazards identified and coordinate the strategies identified in the Plan with other planning programs and mechanisms under our jurisdictional authority.

 

5.                     As a participant in the Essex County Mitigation Planning Committee, the City will continue to support the coalition of other participating municipalities in the County of Essex as described within the Plan and help to promote and support the mitigation successes of all participants in this Plan.

 

6.                     The City believes that mitigation planning is an integral part of government and partner organizations and will incorporate mitigation planning as an integral component of the City’s operations.

 

7.                     In accordance with the DMA 2000 regulations will provide an update of the Plan in conjunction with the County no less than every five (5) years.

 

8.                     The resolution is ratified from June 1, 2020 to the date of adoption of this resolution.

 

 

STATEMENT

 

This resolution ratifies and authorizes the City of Newark, which is a contributing member of the Essex County Mitigation Planning Council, to adopt the 2020 Essex County All Hazard Mitigation Plan Update as the City’s Natural Hazard Mitigation Plan, and shall execute the actions identified in the Plan that pertain to our jurisdiction, in an effort to address the natural hazards and remain in compliance with the Disaster Mitigation Act of 2000.  No municipal funds are required.
