WHEREAS, the City of Newark wishes to enter into a Reimbursement Agreement (the “Agreement”) with the County of Essex, 465 Martin Luther King Boulevard, Newark, New Jersey 07102 (the “County”) for economic damage and hardships stemming from COVID-19 Public Health Emergency and Public Health Crisis; and
WHEREAS, the United States of America, the State of New Jersey, the County, and the City of Newark have become victims of the COVID-19 Virus and Pandemic (the "Coronavirus"); and
WHEREAS, the Coronavirus has caused economic damage and hardships to states, counties, and municipalities throughout the United States of America; and
WHEREAS, on March 27, 2020, President Donald J. Trump signed the Coronavirus Aid Relief and Economic Security Act (the "CARES Act"); and
WHEREAS, the CARES Act was enacted, among other purposes, in order to combat the economic damage caused to states, counties and municipalities because of the Coronavirus; and
WHEREAS, the County has received CARES Act funds from the United States Treasury (the "Stimulus Funds") to be used to reimburse the County, and municipalities and agencies within the County (the "Municipalities"), including the City of Newark, due to economic damage caused to them by the Coronavirus; and
WHEREAS, the County has allocated Ten Million Nine Hundred Thirty-Two Thousand Three Hundred Two Dollars and Forty-Seven Cents ($10,932,302.47) of the Stimulus Funds to the City of Newark; and
WHEREAS, as the recipient of the Stimulus Funds it will be the responsibility of the County to disburse the Stimulus Funds to eligible recipients to include the City of Newark in accordance with the terms and provisions of the CARES Act and any guidelines or regulations issued by United States government or any of its agencies and/or departments, to include the Coronavirus Relief Fund-Guidance for State, Territorial, Local and Tribal Governments - April 22, 2020 (the “Guidelines”) attached as Schedule A of the Agreement; and
WHEREAS, the County’s process to accept applications for reimbursement from the Stimulus Funds allocated to the City in the amount of Ten Million Nine Hundred Thirty-Two Thousand Three Hundred Two Dollars and Forty-Seven Cents ($10,932,302.47) is attached as Schedule B to the Agreement; and
WHEREAS, the Municipal Council finds it in the best interest of the City of Newark to execute the Reimbursement Agreement with the County.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Business Administrator, on behalf of the City of Newark is hereby authorized to enter into and execute the Reimbursement Agreement with the County of Essex, 465 Martin Luther King Boulevard, Newark, New Jersey 07102 to accept the allocation of Ten Million Nine Hundred Thirty-Two Thousand Three Hundred Two Dollars and Forty- Seven Cents ($10,932,302.47) of CARES Act funds from the United States Treasury.
2. The term of the Agreement is from May 12, 2020 through December 31, 2020, or the depletion of the Stimulus Funds, whichever occurs sooner.
3. The Business Administrator, on behalf of the City of Newark is hereby authorized to submit applications to the County requesting reimbursements from the Stimulus Funds to combat the economic damage and hardship caused by the Coronavirus pandemic, pursuant to the Agreement and in accordance with Coronavirus Relief Fund-Guidance for State, Territorial, Local and Tribal Governments - April 22, 2020.
4. The Business Administrator, on behalf of the City of Newark is hereby authorized to accept the reimbursements from the County.
5. If the County receives additional CARES Act funds from the United States Treasury to be used to reimburse the County and the municipalities and agencies within the County, including the City of Newark, due to economic damage caused to them by the Coronavirus, the City of Newark is hereby authorized to submit additional applications for reimbursement, accept said reimbursements, and the provisions of the Agreement shall apply.
6. The Municipal Council, hereby ratifies its authorization of the execution of the Agreement, submission of any applications for reimbursements, and acceptance of any reimbursements from the date of execution of the Agreement, submission of any applications for reimbursements, and acceptance of any reimbursements to the date of adoption of this authorizing resolution.
7. The Business Administrator, on behalf of the City of Newark shall file a fully executed copy of the Reimbursement Agreement with the County of Essex in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Business Administrator, to enter into and execute the attached Reimbursement Agreement with the County of Essex to accept the allocation of $10,932,302.47 of CARES Act funds from the United States Treasury, submit applications for reimbursements, and accept said reimbursements.
