WHEREAS, The Newark Firefighters Union, Inc., located at 238 Murray Street, Newark, New Jersey 07114, wishes to donate one (1) Unimac 60lb capacity industrial hard mount washer/extractor and two (2) portable 4 set turnout gear, eight (8) face mask dryers; and
WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies, and gifts made to it and is empowered to utilize such bequests, legacies, and gifts in the manner set forth in the conditions of the bequest, legacy, and gift provided, however, that such bequest, legacy, or gift shall not be put to any use, which is inconsistent with the laws of the State of New Jersey and the United States of America; and
WHEREAS, the Newark Firefighters Union, Inc., is donating the one (1) Unimac 60lb capacity industrial hard mount washer/extractor and two (2) portable 4 set turnout gear, eight (8) face mask dryers, inclusive of parts and installation, at no cost to the City; and
WHEREAS, the Unimac 60lb capacity industrial hard mount washer/extractor and two (2) portable 4 set turnout gear, eight (8) face mask dryers, has an approximate total value of Forty-Nine Thousand Eight Hundred Eighty-One Dollars and Ninety-Eight Cents ($49,881.98); and
WHEREAS, pursuant to N.J.S.A 40A:5-29, the Department of Public Safety, desires to accept the gift of one (1) Unimac 60lb capacity industrial hard mount washer/extractor and two (2) portable 4 set turnout gear, eight (8) face mask dryers to aid in the protection of the members of the Fire Division.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council authorizes the Director of the Department of Public Safety, on behalf of the City of Newark, to accept the donation from the Newark Firefighters Union, Inc., 238 Murray Street, Newark, New Jersey 07114, of one (1) Unimac 60lb capacity industrial hard mount washer/extractor and two (2) portable 4 set turnout gear, eight (8) face mask dryers, with an approximate total value of Forty-Nine Thousand Eight Hundred Eighty-One Dollars and Ninety-Eight Cents ($49,881.98), to aid in the protection of the members of the Fire Division.
2. No municipal funds shall be expended for the acceptance of this donation.
3. The City is authorized, if requested by the Newark Firefighters Union, Inc., to hold both entities harmless and indemnify them for their assistance of this donation.
4. The Director of the Department of Public Safety shall file a copy of the donation letter and a Hold Harmless Agreement, if requested, in the Office of the City Clerk.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Public Safety, on behalf of the City of Newark, to accept the donation of one (1) Unimac 60lb capacity industrial hard mount washer/extractor and two (2) portable 4 set turnout gear, eight (8) face mask dryers from the Newark Firefighters Union, Inc., 238 Murray Street, Newark, New Jersey 07114, to aid in the protection of the members of the Fire Division. This donation is at no cost to the City of Newark, and the City will provide a Hold Harmless Agreement, if requested.
