WHEREAS, in February 2019, United States Department of Health and Human Services (HHS), Health Resources and Services Administration (HRSA), announced a new initiative, "Ending the HIV Epidemic: A Plan for America-Ryan White HIV/AIDS Program Parts A and B". This 10-year initiative beginning in 2020 seeks to achieve the important goal of reducing new HIV infections in the United States to less than 3,000 per year by 2030; and
WHEREAS, the first phase of the initiative will focus on forty-eight (48) counties, Washington, D.C., San Juan, Puerto Rico, and seven (7) states that have a substantial rural HIV burden. By focusing on these jurisdictions in the first phase of the initiative, HHS plans to reduce new HIV infections by seventy-five percent (75%) within five (5) years. Across the United States, the initiative will promote and implement the Four Pillars to substantially reduce HIV transmissions: (1) Diagnose (as early as possible); (2) Treat (rapidly and effectively to reach sustained viral suppression); (3) Prevent (transmission using proven interventions, including pre-exposure prophylaxis and syringe services programs); and (4) Respond (quickly to potential HIV outbreaks to get needed prevention and treatment services to people who need them); and
WHEREAS, on August 13, 2019, HRSA, through Authorization (Legislation/Regulation) Public Health Service Act, Section 311(c) (42 USC 243(c)) and Title XXVI (42 U.S.C. ?? 300ff-11 et seq.) announced Notice of Funding opportunity for its program titled "Ending the HIV Epidemic: A Plan for America - Ryan White HIV/AIDS Program Parts A and B"; and
WHEREAS, the City's Department of Health and Community Wellness (hereinafter, "DHCW"), Ryan White Unit, desires to provide Ryan White/Ending the HIV Epidemic: A Plan for America-Ryan White HIV/AIDS Program Parts A and B, and participate in the initiative and first phase that will promote and implement the Four Pillars to substantially reduce HIV transmissions: (1) Diagnose (as early as possible); (2) Treat (rapidly and effectively to reach sustained viral suppression); (3) Prevent (transmission using proven interventions, including pre-exposure prophylaxis and syringe services programs; and (4) Respond (quickly to potential HIV outbreaks to get needed prevention and treatment services to people who need them) to reduce new HIV infections by seventy-five percent (75%) within five (5) years; and
WHEREAS, on October 15, 2019, on behalf of the City of Newark (hereinafter, "City"), the Director of the DHCW submitted an application to the HHS, HRSA, 5600 Fishers Lane, Rockville, Maryland 20857, requesting funding in the amount of Twenty-One Million Eight Hundred Fourteen Thousand One Dollars and Zero Cents ($21,814,001.00) budgeted over a five year period from FY2020 through FY2024, for the provision of Ryan White/Ending the HIV Epidemic: A Plan for America-Ryan White HIV/AIDS Program Parts A and B, health, social and related services to HIV/AIDS-infected individuals and families and in the City of Newark and the Newark EMA and support the national goal of reducing new HIV infections to less than 3,000 per year by 2030 (a copy of the Five Year Budget is attached); and
WHEREAS, Resolution 7R5-a adopted on July 2, 2020, authorizing the application and FY2020 acceptance grant erroneously set forth the application amount as $4,000,000.00 for a five year period which should be amended to an application amount of Twenty-One Million Eight Hundred Fourteen Thousand One Dollars and Zero Cents ($21,814,001.00) for the five year period; and
WHEREAS, HRSA will notify the City each year the amount of the grant award for each fiscal year; and
WHEREAS, as a result of the City's application, HRSA has notified the City of a FY2021 award in the amount of One Million Six Hundred Thousand Sixty-Seven Dollars and Zero Cents ($1,667,000.00), to provide Ryan White/Ending the HIV Epidemic: A Plan for America-Ryan White HIV/AIDS Program Parts A and B, related services and participate in the initiative and first phase that will promote and implement the Four Pillars to substantially reduce HIV transmissions: (1) Diagnose (as early as possible); (2) Treat (rapidly and effectively to reach sustained viral suppression); (3) Prevent (transmission using proven interventions, including pre-exposure prophylaxis and syringe services programs; and (4) Respond (quickly to potential HIV outbreaks to get needed prevention and treatment services to people who need them) to reduce new HIV infections by seventy-five percent (75%) within five (5) years to HIV/AIDS-infected individuals and families in the City of Newark and Newark Eligible Metropolitan Area, and support the national goal of reducing new HIV infections to less than 3,000 per year by 2030, with no City funds required; and
WHEREAS, the DHCW desires to accept said grant funds in the amount of One Million Six Hundred Thousand Sixty-Seven Dollars and Zero Cents ($1,667,000.00); and
WHEREAS, funding will be provided in the form of a cooperative agreement. A cooperative agreement, as opposed to a grant, is an award instrument of financial assistance where substantial involvement is anticipated between HRSA and the recipient during performance of the contemplated project. The recipient is expected to collaborate with the HIV/AIDS Bureau (HAB) and its RWHAP recipients to achieve the expectations described in the program expectations section. Certain activities must be planned jointly and include HAB's input. HRSA HAB must be aware of all project activities in sufficient time to provide input and/or assistance. This substantial involvement is in addition to the usual monitoring and technical assistance provided under the cooperative agreement; and
WHEREAS, the HRSA does not require the City to execute a grant agreement or cooperative agreement in order to accept the aforementioned grant award.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are authorized to submit an application to the United States Department of Health and Human Services, Health Resources and Services Administration, 5600 Fishers Lane, Rockville, Maryland 20857, requesting grant funds in the amount of Twenty-One Million Eight Hundred Fourteen Thousand One Dollars and Zero Cents ($21,814,001.00) budgeted over a five year period from FY2020 through FY2024, to provide Ryan White/Ending the HIV Epidemic: A Plan for America-Ryan White Program Parts A and B related services, and participate in the initiative and first phase that will promote and implement the Four Pillars to substantially reduce HIV transmissions: (1) Diagnose (as early as possible); (2) Treat (rapidly and effectively to reach sustained viral suppression); (3) Prevent (transmission using proven interventions, including pre-exposure prophylaxis and syringe services programs; and (4) Respond (quickly to potential HIV outbreaks to get needed prevention and treatment services to people who need them) to reduce new HIV infections by seventy-five percent (75%) within five (5) years to HIV/AIDS-infected individuals and families in the City of Newark and Newark Eligible Metropolitan Area, and support the national goal of reducing new HIV infections to less than 3,000 per year by 2030, with no City funds required (a copy of the grant application is attached hereto and made a part hereof).
2. The Municipal Council ratifies its authorization of this grant application from the date of application submission to the date of adoption of this authorizing resolution.
3. The Municipal Council ratifies, authorizes and amends Resolution 7R5-a adopted on July 2, 2020, to correctly reflect the grant application amount to be Twenty-One Million Eight Hundred Fourteen Thousand One Dollars and Zero Cents ($21,814,001.00) for the five year period.
4. The grant award for FY 2021 in the amount of One Million Six Hundred Thousand Sixty-Seven Dollars and Zero Cents ($1,667,000.00), from the United States Department of Health and Human Services, HRSA, is hereby accepted (a copy of the grant award is attached hereto and made a part hereof).
5. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are authorized to receive and expend the grant award, through Request for Proposals, to provide Ryan White/Ending the HIV Epidemic: A Plan for America- Ryan White Program Parts A and B, related services and participate in the initiative and first phase that will promote and implement the Four Pillars to substantially reduce HIV transmissions: (1) Diagnose (as early as possible); (2) Treat (rapidly and effectively to reach sustained viral suppression); (3) Prevent (transmission using proven interventions, including pre-exposure prophylaxis and syringe services programs; and (4) Respond (quickly to potential HIV outbreaks to get needed prevention and treatment services to people who need them) to reduce new HIV infections by seventy-five percent (75%) within five (5) years to HIV/AIDS-infected individuals and families in the City of Newark and the Newark EMA and support the national goal of reducing new HIV infections to less than 3,000 per year by 2030, for the period commencing on March 1, 2021 and terminating on February 28, 2022 (a copy of the grant award is attached hereto and made a part hereof).
6. The Municipal Council ratifies the acceptance of this grant award from March 1, 2021 to the date of adoption of this authorizing resolution.
7. The City's acceptance and expenditure of any additional FY2021 Ryan White grant funds from HRSA shall be subject to the approval of the Municipal Council by resolution.
8. No municipal funds are required for receipt or acceptance of this grant award.
9. The Director of the Department of Health and Community Wellness shall file a fully executed copy of the grant application and the grant award letter in the Office of the City Clerk.

This Resolution ratifies, amends and authorizes the actions taken by the Director of the Department of Health and Community Wellness to submit an application for grant funding in the amount of Twenty-One Million Eight Hundred Fourteen Thousand One Dollars and Zero Cents ($21,814,001.00) budgeted over a five year period from FY2020 through FY2024, to provide Ryan White/ Ending the HIV Epidemic: A Plan for America-Ryan White Program Parts A and B related services, and participate in the initiative and first phase that will promote and implement the Four Pillars to substantially reduce HIV transmissions and support the national goal of reducing new HIV infections to less than 3,000 per year by 2030, and to accept FY 2021 grant funds in the amount of One Million Six Hundred Thousand Sixty-Seven Dollars and Zero Cents ($1,667,000.00), for the period commencing on March 1, 2021 and terminating on February 28, 2022. No municipal funds are required for receipt or acceptance of this grant award.
