WHEREAS, the Municipal Council, by Resolution 7R11-b, adopted on December 22, 2020, entered into a Memorandum of Understanding ("MOU") with Newark Arts Council, Inc., 17 Academy Street, Newark, New Jersey 07102, to serve as the Fiscal Agent to receive public and private donations in support of the Harriet Tubman Monument Project; and
WHEREAS, due to the fundraising efforts of both the City of Newark (the "City") and Newark Arts Council, Inc., the Andrew W. Mellon Foundation, 40 East 62nd Street, New York, New York 10065 ("Mellon") has provided a grant in the amount of Three Hundred Fifty Thousand Dollars and Zero Cents ($350,000.00) to the Newark Arts Council, Inc. on behalf of the City of Newark to help support the Harriett Tubman Monument Project; and
WHEREAS, on or about December 13, 2021, Mellon provided an award letter and payment schedule (attached hereto) for the acceptance of the grant funds, which requires that the funds be used by December 31, 2...
