WHEREAS, Federal Highway Administration (FHWA) makes funds available for local transportation related projects of public entities of federal aid funds and those funds are administered by and through the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey, Department of Transportation (NJDOT) for Local Safety Programs; and
WHEREAS, on June 15, 2015, the North Jersey Transportation Planning Authority (NJTPA) invited the City of Newark to submit proposals for the FY 2016-2017 solicitation of the Local Safety and High Risk Rural Roads Program; and
WHEREAS, on September 1, 2015, the City of Newark, Department of Engineering, submitted a proposal for the FY 2016-2017 Local Safety Program High Risk Rural Roads Program to the North Jersey Transportation Planning Authority (NJTPA) for the Broad Street Pedestrian Safety Corridor Improvements requesting grant funding in the amount of $3,475,000.00; and
WHEREAS, as a result of this proposal, on February 25, 2016, the North Jersey Transportation Planning Authority (NJTPA) notified the City of Newark that the NJTPA Board of Trustees had approved grant funding through the FY 2016-2017 Local Safety High Risk Rural Roads Program for the Broad Street Pedestrian Safety Corridor Improvements, in the amount of $3,475,000.00; and
WHEREAS, on June 15, 2016, the Municipal Council adopted Resolution 7R4-e, which ratified and authorized the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to apply for, accept and enter into a grant agreement for grant funds in the amount of $3,475,000.00 for the Broad Street Pedestrian Safety Corridor Improvements; and
WHEREAS, on November 3, 2021, the City of Newark submitted to the NJDOT a cost proposal for the construction inspection services for Broad Street Phase II Pedestrian Safety Improvements in the amount of $452,198.41 (a copy of the cost proposal is attached hereto and made a part hereof); and
WHEREAS, the City of Newark submitted to NJDOT the plans, specifications and engineering estimate for Broad Street Phase II Pedestrian Safety Improvements in the amount of $4,404,059.10; and
WHEREAS, on February 22, 2022 NJDOT notified the City of Newark that the Federal Highway Administration (FHWA) authorized funding in the amount of $4,404,059.10 for construction and $452,198.41 for construction inspection for Broad Street Phase II Pedestrian Safety Improvements (a copy of the February 22, 2022 notification from the NJDOT is attached hereto and made a part hereof); and
WHEREAS, the City of Newark seeks to amend Resolution 7R4-e adopted on June 15, 2016, to accept the additional grant funds to increase the overall project costs of the Broad Street Phase II Pedestrian Safety Improvements from $3,475,000.00 to $4,856,257.51 ($4,404,059.10 for construction and $452,198.41 for construction management/inspection).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized, on behalf of the City of Newark, to accept the additional grant funds increase in the amount of $1,381,257.51 from the Federal Highway Administration (FHWA) as administered by NJDOT to the overall project costs for the Broad Street Phase II Pedestrian Safety Improvements from $3,475,000.00 to $4,856,257.51 ($4,404,059.10 for construction and $452,198.41 for construction management/inspection).
2. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the NJDOT to increase the overall grant for the project cost of the Broad Street Phase II Pedestrian Safety Improvements from $3,475,000.00 to $4,856,257.51 ($4,404,059.10 for construction and $452,198.41 for construction management/inspection).
3. The agreement between the City of Newark and the NJDOT is hereby ratified from February 22, 2022 to the date of adoption of this authorizing Resolution.
4. No municipal funds are required for receipt or acceptance of this grant award.
5. No work shall commence prior to the receipt and budget insertion of the grant funds from the New Jersey Department of Transportation.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to accept grant funds from Federal Highway Administration (FHWA) as administered by NJDOT and enter into and execute an agreement with the NJDOT to increase the grant funding from $3,475,000.00 to $4,856,257.51 ($4,404,059.10 for construction and $452,198.41 for construction management/inspection) increasing the overall project costs for the Broad Street Phase II Pedestrian Safety Improvements. No municipal funds are required for receipt or acceptance of this additional grant funding.
