WHEREAS, the City of Newark is in need of an analysis of parking conditions throughout the City of Newark including analysis of future parking needs and potential revenue therefrom; and
WHEREAS, on December 1, 2021 the Municipal Council adopted resolution 7R4-a authorizing the use of Competitive Contracting for Parking Consultant Services as per N.J.S.A. 40A:11-4.1 et seq.; and
WHEREAS, the City of Newark advertised for bids pursuant to the Competitive Contracting Law, N.J.S.A. 40A:11-4.1 for Parking Consultant Services on January 14, 2022; and
WHEREAS, six (6) individuals/vendors requested a proposal packet; and
WHEREAS, the City received two (2) proposals: one from DESMAN, Inc., 3 West 35th Street, 3rd Floor, New York, New York 10001; and the other from Walker Consultants, 49 West 38th Street, 9th Floor, New York, New York 10018; and
WHEREAS, the proposal received from DESMAN, Inc., 3 West 35th Street, 3rd Floor, New York, New York 10001, was found to be the most responsible bidder and in the best interest of the City of Newark to accept as to price and other factors considered; and
WHEREAS, the City of Newark wishes to enter into a Professional Services Contract with DESMAN, Inc., 3 West 35th Street, 3rd Floor, New York, New York 10001 to provide Parking Consultant Services for the City of Newark, Department of Finance; and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council hereby authorizes the use of competitive contracting, pursuant to N.J.S.A 40A:11-4.1 et seq. to award a contract for Parking Consultant Services.
2. The term of this contract will be one (1) year from the date of the issuance of a written Notice to Proceed.
3. The contract will not exceed $84,900.00.
4. This contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law (N.J.S.A. 19:33A-20.5) and pursuant to the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-5(1)(a)(i).
5. The Certification of Funds in the amount of Eighty-Four Thousand Nine Hundred Dollars ($84,900.00) is attached. A copy of the Certification of Funds shall be filed in the office of the City Clerk.
6. Certified copies of the fully executed contracts shall be filed with the City of Newark Municipal Clerk by the Director of Finance/Chief Financial Officer of the City of Newark.
7. A notice of the award of the contract shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of the adoption of this Resolution.
STATEMENT
This Resolution authorizes the Professional Services Contract between the City of Newark and DESMAN, Inc., 3 West 35th Street, 3rd Floor, New York, New York 10001, to provide Parking Consultant Services for the City of Newark, Department of Finance, in an amount not to exceed $84,900.00 for a term of one (1) year from the date of the issuance of a written Notice to Proceed.
