Additional Information:

To authorize Membership in the Sourcewell Cooperative and to utilize Contract #081120-PCR for the design, purchase and installation of fitness equipment for the renovation of John F. Kennedy Recreation Center, which will minimize costs and increase efficiency and product quality for the City’s Department of Recreation, Cultural Affairs and Senior Services.

                        WHEREAS, the City of Newark (“City”), in furtherance of its goals to search for lower costs, greater efficiency and improved product quality, wishes to enter into an Interlocal Contract for Cooperative Purchasing; and

 

WHEREAS, cooperative purchasing is an inclusive term used to describe all purchasing systems where two (2) or more local contracting units join together for the provision or performance of goods or services as provided for by the Local Public Contracts Law, N.J.S.A. 40A:11-1et seq.; and

 

WHEREAS, the purchase of goods or services, by two (2) or more contracting units, increases proportionate saving in costs gained by an increased level of production; and 

 

WHEREAS, the City, a sub-political body of the State of New Jersey is permitted to join Cooperative Purchasing Programs, pursuant to N.J.S.A. 52:34-6.2(b)(3); and

 

WHEREAS, N.J.S.A. 40A:11-10(a)(1) authorizes two (2) or more contracting units to establish a Cooperative Pricing System and to enter into a Cooperative Pricing Agreement for its administration; and

 

WHEREAS, the Sourcewell Cooperative, a locally recognized and accepted cooperative purchasing organization, maintains Local Cooperative Agreement Contracts, which are competitively awarded through which members can make purchases; and

 

WHEREAS, the Sourcewell Cooperative - a Cooperative Pricing System was developed for the purpose of utilizing a competitive bidding process to make the procurement process more efficient and provide cost savings to its members; and          

 

WHEREAS, the Sourcewell Cooperative has offered the City of Newark the opportunity to participate in their Cooperative Purchasing System; and

 

WHEREAS, the City desires to enter into an agreement with the Sourcewell Cooperative to become a member and utilize Contract #081120-PCR and its Cooperative Pricing System (through EnerG Fitness and Wellness Solutions, 23 Fontana Lane, Suite 105, Baltimore, Maryland 21237) to design, purchase and install fitness equipment for the renovation of John F. Kennedy Recreation Center from the date of adoption of this Resolution until October 1, 2024 (attached hereto).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designees, the Qualified Purchasing Agent, QPA and/or the Business Administrator are hereby authorized to enter into and execute a Cooperative Pricing Agreement under the Sourcewell Cooperative (through EnerG Fitness and Wellness Solutions, 23 Fontana Lane, Suite 105, Baltimore, Maryland 21237) and utilize Contract #081120-PCR, through its Cooperative Pricing System, for the period commencing upon approval of this resolution by the Municipal Council through October 1, 2024, for a total amount not to exceed Two Hundred Seventeen Thousand Four Hundred Thirty-One Dollars and Sixty-Four Cents ($217,431.64).

 

2.                      The Division of Central Purchasing through the Qualified Purchasing Agent, QPA, shall ensure that the goods and/or services procured through the system comply with applicable laws of the State of New Jersey, Local Public Contracts Law, N.J.S.A. 40A:11-1et seq. and all other provisions of the revised statutes of the State of New Jersey.

 

3.                     Attached hereto is a Certification of Funds from the Chief Financial Officer, which states that funds in the amount of Two Hundred Seventeen Thousand Four Hundred Thirty-One Dollars and Sixty-Four Cents ($217,431.64), are available in the Department of Recreation Cultural Affairs and Senior Services: NW027-A08 EW870-72090-B2008, NW027-A85-ECOHO-83840-B2001, NW027-A90-EH240-71280-B2001, NW027-A15-EC5DO-72090-B2015, NW027-A18 EC841-71910-B2018 and NW027-A18-EC831-72090-B2018 and which shall be filed along with the original Resolution in the Office of the City Clerk.

 

4.                      Any purchases procured through Sourcewell Cooperative are subject to Municipal Council approval.

 

5.                     A duly executed copy of the Cooperative Purchasing Contract is attached hereto to be forthwith filed in the Office of the City Clerk by the Qualified Purchasing Agent, QPA.

 

6.                     If required by State law, the City Clerk shall provide the appropriate notice of the authorization of this contract usage to the State Comptroller, no later than twenty (20) business days following such authorization, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

 

STATEMENT

 

This Resolution authorizes the Mayor of the City of Newark and/or his designees, the Qualified Purchasing Agent, QPA and/or the Business Administrator, to enter into and execute a membership agreement with Sourcewell Cooperative and utilize Contract #081120-PCR for the purpose of purchasing from their Cooperative Purchasing Program, (through EnerG Fitness and Wellness Solutions, 23 Fontana Lane, Suite 105, Baltimore, Maryland 21237) and utilizing of Contract #081120-PCR to allow the City of Newark to procure goods and services which will maximize procurement dollars, improve product quality and increase efficiency for the period commencing upon approval of this resolution by the Municipal Council through October 1, 2024, for a total amount not to exceed $217,431.64.
