WHEREAS, the State of New Jersey Department of Transportation (“NJDOT”) State Aid to Counties and Municipalities, Local Freight Impact Fund (LFIF-19) provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and
WHEREAS, on January 9, 2019, the Director of the Department of Engineering, on behalf of the City of Newark (the “City”), submitted LFIF-2019-Doremus Avenue Port Newark Connect-00042 application electronically to NJDOT requesting grant funding; and
WHEREAS, on February 13, 2019, the Municipal Council adopted Resolution 7R3-a(S) ratifying and authorizing the Director of the Department of Engineering to apply for, accept, and enter into grant documents for a grant award for LFIF-2019-Doremus Avenue Port Newark Connect-00042, NJDOT; and
WHEREAS, on July 18, 2019, NJDOT announced that the City was selected to receive a grant award in the amount of One Million Six Hundred Forty-Eight Thousand Five Hundred Thirteen Dollars and Zero Cents ($1,648,513.00), for the construction of LFIF-2019-Doremus Avenue Port Newark Connect-00042 (hereinafter the “Project”); and
WHEREAS, NJDOT requires the City to bid and award the contract for construction of the Project, within thirty-six (36) months of the announcement of the receipt of a grant award, which falls on July 18, 2022; and
WHEREAS, due to COVID-19 related restrictions, limited staff and NJDOT concerns that certain sidewalks of the Project are in close proximity of railroad tracks, the City was unable to timely secure the required permits necessary to go forward with the procurement process, resulting in delay of the bid and award of the contract for the Project, on or before the July 18, 2022 deadline; and
WHEREAS, due to the delays in the permitting process, the City wishes to request from NJDOT, by Extension Justification Request Letter (attached hereto), extension of the deadline from July 18, 2022 to January 18, 2023, to allow the City to bid and award a contract for this Project.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering are authorized to request an extension of the deadline from New Jersey Department of Transportation (NJDOT), from July 18, 2022 to January 18, 2023, to allow the City to bid and award a contract for construction of LFIF-2019-Doremus Avenue Port Newark Connect-00042 project.
2. All other terms and conditions of the grant award from the NJDOT of LFIF-2019-Doremus Avenue Port Newark Connect-00042 project shall remain in force and effect until the contract is completed.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering to request an extension of the deadline from New Jersey Department of Transportation (NJDOT), from July 18, 2022 to January 18, 2023, to allow the City of Newark to bid and award a contract for construction of LFIF-2019-Doremus Avenue Port Newark Connect-00042 project. No municipal funds are required.
