WHEREAS, HB Sports and Entertainment (Prudential Center of Newark), 3 Banner Way, Camden, New Jersey, 08103, would like to donate 70 new basketballs to the City of Newark to make basketball activity more accessible to Newark residents.  It has been recognized by HB Sports that physical fitness is a key component of a healthy lifestyle, especially in children and adolescents.  These basketballs are new, and have a value of approximately Three Thousand Dollars and Zero Cents ($3,000.00); and

 

WHEREAS, the Acting Director of the Department of Recreation, Cultural Affairs & Senior Services  (“Department”) desires to accept the gift of the basketballs and acknowledge the donation; and

 

WHEREAS, the City of Newark desires to expand and enrich the recreational opportunities to the residents of Newark and to partner with HB Sports and Entertainment (Prudential Center of Newark), by creating opportunities for all Newark residents, especially the City’s youth, and improving the activity in basketball sports; and

 

WHEREAS, Harris Blitzer (HB) Sports and Entertainment (Prudential Center of Newark) fully understands and agrees that it is not entitled to receive any direct benefit from the City of Newark, Mayor Ras J. Baraka, or any other personnel affiliated with the City of Newark in exchange for the gift; and

 

WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America.

 

 NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or the Acting Director of the Department of Recreation, Cultural Affairs & Senior Services are authorized to accept the gift from Harris Blitzer (HB) Sports and Entertainment (Prudential Center of Newark), 3 Banner Way, Camden, New Jersey, 08103, of seventy (70) new basketballs to make basketball activity more accessible to Newark residents at City of Newark Recreation Centers.   

 

2.                     The seventy (70) new basketballs have a value of approximately Three Thousand Dollars and Zero Cents ($3,000.00.)

 

3.                     The City acknowledges the generous donation of the basketballs through this resolution. 

 

4.                     The acceptance of the gift is ratified from approximately July 1, 2022, to the date of adoption of this authorizing resolution.

 

5.                     No municipal funds will be expended for the acceptance of this gift.

 

 

STATEMENT

 

This Resolution ratifies and authorizes the Mayor and/or the Acting Director of the Department of Recreation, Cultural Affairs & Senior Services to accept the gift from Harris Blitzer Sports and Entertainment (Prudential Center of Newark), of seventy new basketballs to make basketball activity more accessible to Newark residents at City of Newark Recreation Centers. The gift of the Basketballs is valued at approximately $3,000.00. No municipal funds will be expended for the acceptance of this gift.
