WHEREAS, The New Fun Services, LLC, 9 Kurlick Road, Fairfield, New Jersey, 07004 wishes to provide a gift valued at Four Thousand, Four Hundred Dollars and Zero Cents ($4,400.00) to the City of Newark for the purpose of providing entertainment and services, specifically to provide for entertainment, equipment, staff and food in accordance with The New Fun Services donation letter (attached hereto) for the benefit of the Department of Recreation, Cultural Affairs and Senior Services (“Department”),for the Pop-up Play Street” located at Riverside Villa, 13 Grafton Avenue, Newark, New Jersey 07104, being held on or about July 14, 2022,; and
WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America; and
WHEREAS, The New Fun Services, LLC fully understands and agrees it is not entitled to receive any direct benefit from the City of Newark in exchange for this gift; and
WHEREAS, the Director of the Department desires to accept the gift valued at Four Thousand, Four Hundred Dollars and Zero Cents ($4,400.00) from The New Fun Services, LLC., for the purpose of providing entertainment and services for the City of Newark, pursuant to N.J.S.A. 40A:5-29; and
WHEREAS, the Department wishes to utilize The New Fun Services, LLC gift valued at Four Thousand, Four Hundred Dollars and Zero Cents ($4,400.00) for equipment and services at the “Pop-up Play Street” located at Riverside Villa, 13 Grafton Avenue, Newark, New Jersey 07104, being held on or about July 14, 2022, during 2022 Newark Summer Fun in the City, to provide for entertainment, equipment, staff and food, pursuant to the terms of The New Fun Services, LLC., donation letter.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or the Director of the Department of Recreation, Cultural Affairs & Senior Services are authorized to accept the gift valued at Four Thousand Four Hundred Dollars and Zero Cents ($4,400.00) from The New Fun Services, LLC, 9 Kurlick Road, Fairfield, New Jersey, 07004, for entertainment and services, in accordance with The New Fun Services, LLC., donation letter (attached hereto), to provide for entertainment, equipment, staff and food, for the “Pop-up Play Street” located at Riverside Villa, 13 Grafton Avenue, Newark, New Jersey 07104, being held on or about July 14, 2022, during 2022 Newark Summer Fun in the City.
2. The acceptance of the gift is ratified from July 14, 2022, to the date of adoption of this authorizing resolution.
3. No municipal funds will be expended for the acceptance of this gift.
STATEMENT
This Resolution ratifies and authorizes the Mayor and/or the Director of the Department of Recreation, Cultural Affairs & Senior Services to accept the gift from The New Fun Services, LLC, 9 Kurlick Road, Fairfield, New Jersey, 07004, valued at of $4,400.00, for the purpose of providing entertainment and services to the City of Newark, to provide for entertainment, equipment, staff and food, for the “Pop-up Play Street” located at Riverside Villa, 13 Grafton Avenue, Newark, New Jersey 07104, held on July 14, 2022, during 2022 Newark Summer Fun in the City No municipal funds will be expended for the acceptance of this gift.
