WHEREAS, the City of Newark (the "City") requires Professional Engineering Services to conduct Engineering Analysis of High Hazard Dam for the City, and as such, the Department of Water and Sewer Utilities issued a Request for Qualifications (RFQ) on January 22, 2022; and

WHEREAS, the Department of Water and Sewer Utilities distributed ten (10) RFQ packages to prospective vendors following the date of Advertisement;
and

WHEREAS, on February 9, 2022, the Department of Water and Sewer Utilities received three (3) proposals in response to its RFQ; and

WHEREAS, the City is abandoning RFQ Project in order to expand the project scope of work and has substantially revised the scope of work, pursuant to N.J.S.A. 40A:11-13.2(d); and

WHEREAS, due to the urgency of the project, the Director of the Department of Water and Sewer Utilities has determined to proceed with the award of a contract without a competitive process through a Non-Fair and Open process; and
