WHEREAS, the City's Department of Engineering, Division of Traffic and Signals (the "City") is in need of professional services to prepare a Bicycle and Pedestrian Plan for the City; and

WHEREAS, the New Jersey Department of Transportation (NJDOT) provides assistance for Bicycle and Pedestrian Planning through the Bicycle and Pedestrian Planning Assistance Program; and

WHEREAS, under this program, NJDOT has retained the services, of several consultants with expertise in local bicycle and pedestrian planning. The services of these consultants are provided at no cost to counties and municipalities that demonstrate a need and desire to undertake planning activities that will lead to infrastructure improvements to benefit people who travel by walking, biking or transit; and

WHEREAS, the City's Department of Engineering wishes to submit an application for the Bicycle and Pedestrian Planning Assistance Program; and

WHEREAS, upon final authorization of this project from NJDOT, the Acting Director of the Department of Engineering shall submit a copy of the authorization letter and the project agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to submit an application for the Bicycle and Pedestrian Planning Assistance Program.

2. The program award is hereby accepted.

3. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to enter into and execute program documents with NJDOT for the assistance for Bicycle and Pedestrian Planning.

4. Upon notification of final authorization of this project, the Acting Director of the Department of Engineering shall submit a complete copy of the Project Agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.

5. The Acting Director of the Department of Engineering shall file a fully-executed copy of the program award letter, and the Project Agreement in the Office of the City Clerk.


STATEMENT

This Resolution ratifies and authorizes the actions taken by the City's Department of Engineering, to submit an application for the Bicycle and Pedestrian Planning Assistance Program, and furthermore, ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to enter into and execute an agreement with and assistance from the New Jersey Department of Transportation.
