WHEREAS, the USTA Foundation, 10000 USTA Foundation Boulevard, Orlando, Florida, 32827, would like to donate a stipend valued at One Thousand Five Hundred Dollars and Zero Cents ($1,500.00) used to cover transportation costs, meals, additional staffing and/or chaperones at the United States Open 2022. This is an incentive for participation in the Net Generation On-Court Demos during the US Open 2022; and
WHEREAS, the USTA Foundation as part of this donation, will be used to cover transportation costs, meals, additional staffing and/or chaperones at the United States Open 2022 and the funds will be paid to the City of Newark Division of Recreation after the conclusion of the US Open, upon confirmation of attendance; and
WHEREAS, the Director of the Department of Recreation, Cultural Affairs & Senior Services (“Department”) desires to accept the gift of the stipend; and
WHEREAS, the City of Newark desires to use the stipend to cover transportation costs, meals, additional staffing and/or chaperones at the United States Open 2022 and the funds will be paid to the City of Newark Division of Recreation after the conclusion of the US Open, upon confirmation of attendance; and
WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or the Director of the Department of Recreation, Cultural Affairs & Senior Services are authorized to accept the gift from the USTA Foundation, 10000 USTA Foundation Boulevard, Orlando, Florida, 32827, to donate a stipend valued at One Thousand Five Hundred Dollars and Zero Cents ($1500.00) used to cover transportation costs, meals, additional staffing and/or chaperones at the United States Open 2022. This is an incentive for participation in the Net Generation On-Court Demos during the US Open 2022.
2. This gift of One Thousand Five Hundred Dollars and Zero Cents ($1500.00) used to cover transportation costs, meals, additional staffing and/or chaperones at the United States Open 2022.
3. The City acknowledges the generous donation of the stipend through this resolution.
4. The acceptance of the gift is ratified from approximately August 1, 2022, to the date of adoption of this authorizing resolution.
5. The USTA Foundation fully understands and agrees that it is not entitled to receive any direct benefit from the City of Newark, Mayor Ras J. Baraka, or any other personnel affiliated with the City of Newark in exchange for the gift.
6. No municipal funds will be expended for the acceptance of this gift.
STATEMENT
This Resolution ratifies and authorizes the Mayor and/or the Director of the Department of Recreation, Cultural Affairs & Senior Services to accept the gift from the USTA Foundation, 10000 USTA Foundation Boulevard, Orlando, Florida, 32827, to donate a stipend valued at $1,500.00 used to cover transportation costs, meals, additional staffing and/or chaperones at the United States Open 2022. This is an incentive for participation in the Net Generation On-Court Demos during the US Open 2022. No municipal funds will be expended for the acceptance of this gift.
