WHEREAS, the City of Newark, Department of Engineering (the “City”), determined that the Central Avenue Bridge (Structure #0700-N06) over the NJ Transit City Subway, between Jay and Duryea Streets, was in need of major rehabilitation and/or replacement due to its degraded and obsolete infrastructure. The City determined that this project would be broken down into four (4) phases: Phase I, Concept Development; Phase II, Preliminary Engineering; Phase III, Final Design, and Phase IV, Construction; and

 

WHEREAS, on September 17, 2014, the Municipal Council adopted Resolution 7R4-d ratifying and authorizing the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to apply for and accept grant funding from North Jersey Transportation Planning Authority (NJTPA), in the amount of Three Hundred Two Thousand, Four Hundred Dollars and Zero Cents ($302,400.00), for the CR 508 Central Avenue Bridge Over City Subway Replacement Structure project (hereinafter “Central Ave. Bridge Project”), for the City to undertake a comprehensive evaluation of the Central Avenue Bridge; and

 

WHEREAS, the Central Ave Bridge Project recently entered Phase II, Preliminary Engineering. During this phase, the City will begin the preliminary engineering design for the Central Avenue Bridge replacement; and

 

WHEREAS, on May 5, 2022, the City publicly advertised a Request for Proposal (RFP) for the preliminary engineering design of the Central Avenue Bridge replacement; and

 

WHEREAS, on June 9, 2022, two (2) firms, Colliers Engineering and Design (CED), and Michael Baker International, Inc., submitted their responses to the Request for Proposal (RFP); and

 

WHEREAS, the Selection Committee, consisting of personnel from the Department of Engineering, Division of Traffic and Signals and North Jersey Transportation Planning Authority (NJTPA), carefully reviewed the two (2) proposals and selected Michael Baker International, Inc., One Gateway Center, Suite 1601, Newark, New Jersey 07102, for the Local Preliminary Engineering of the Central Avenue Bridge because their proposal was found to fulfill the requirements of the Request for Proposal (RFP) and showed project understanding and meets all project team experience requirements; and

 

WHEREAS, on August 4, 2022, the City sent a letter to the New Jersey Department of Transportation (NJDOT) recommending Michael Baker International, Inc., for Phase II of the Central Ave. Bridge Project. The City also requested additional funds because the project cost proposal was One Million Four Hundred Twenty-Two Thousand Four Hundred Forty-Five and Thirty-Four Cents ($1,422,445.34) more than the City estimated; and  

 

WHEREAS, the NJDOT subsequently informed the City that on September 8, 2022, the Federal Highway Administration (FHWA) authorized funding in the amount of One Million, Four Hundred Twenty-Two Thousand, Four Hundred Forty-Five Dollars and Thirty-Four Cents ($1,422,445.34), without the need for an application from the City, for Phase II of the Central Ave. Bridge Project, with no City funds required; and

 

WHEREAS, the Acting Director of the Department of Engineering desires to accept these funds and enter into a Cost Reimbursement Agreement, identified as Agreement #2022-DT-BLA-209, with the New Jersey Department of Transportation, Division of Local Aid and Economic Development, for the Local Preliminary Engineering Design of the Central Avenue Bridge, Federal Project # 0508002; and

 

WHEREAS, as part of the Cost Reimbursement Agreement, all costs enumerated in the Project Scope of Work and Cost Estimate shall be eligible for reimbursement from the date of contract execution and all such work shall be completed by April 1, 2025, unless either terminated or extended by written authorization of the State; and

 

WHEREAS, the City wishes to appoint the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to act as the authorized person to enter into and execute this Cost Reimbursement Agreement, 2022-DT-BLA-209, and to accept the funds provided in the amount of One Million, Four Hundred Twenty-Two Thousand, Four Hundred Forty-Five Dollars and Thirty-Four Cents ($1,422,445.34) for the Central Ave. Bridge Project, Federal Project #0508002.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept grant funding in the amount of One Million, Four Hundred Twenty-Two Thousand, Four Hundred Forty-Five Dollars and Thirty-Four Cents ($1,422,445.34) for consultant engineering services for the Central Ave. Bridge Project, with no City funds required.

 

2.                     The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to enter into and execute a Cost Reimbursement Agreement for the Central Ave. Bridge Project, Federal Project # 0508002, to receive and expend the above grant award for consultant engineering services as per terms and conditions of the Cost Reimbursement Agreement between the City of Newark and the New Jersey Department of Transportation.

 

3.                     The Cost Reimbursement Agreement #2022-DT-BLA-209 is ratified from the date of the award on September 21, 2022 until the date of adoption of this Resolution.

 

4.                     No municipal funds are required for receipt or acceptance of this award.

 

5.                     The Acting Director of the Department of Engineering shall file a copy of the award letter and a fully executed copy of the Cost Reimbursement Agreement #2022-DT-BLA-209 in the Office of the City Clerk.

 

 

STATEMENT

 

This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to enter into and execute a Cost Reimbursement Agreement, 2022-DT-BLA-209, for the Central Ave. Bridge Project, Federal Project #0508002, with the New Jersey Department of Transportation and to accept funds provided in the amount of $1,422,445.34, as per terms and conditions of the Cost Reimbursement Agreement.
