Additional Information:

This Resolution authorizes the City of Newark to apply for grant funding under the LFIF-2023-Foundry Street Resurfacing Improve-00024 from NJDOT for improvements to Foundry Street, and also authorizes the acceptance of grant funding upon notification of a grant award.

WHEREAS, the New Jersey Department of Transportation’s (NJDOT) Local Freight Impact Fund (LFIF) Grant Program provides funding for transportation projects that address the impact of freight travel to local communities and local transportation infrastructures; and

 

WHEREAS, the City of Newark (the “City”) seeks to obtain funding from FY2023 LFIF Grant Program for improvements to Foundry Street, which includes milling and paving 2½” to 3”, reconstruction of curbs and ADA ramps, crosswalks, new pavement markings, storm water system cleaning and replacement as needed, replacement of broken or worn water valve boxes, manhole frames and covers, and sidewalks on both sides of the street (“Foundry Street Resurfacing Improvements”); and

 

WHEREAS, the City desires to further the public interest by obtaining funding from the FY2023 LFIF Grant Program for the Foundry Street Resurfacing Improvements; and

 

WHEREAS, on December 12, 2022, on behalf of the City of Newark, the Acting Director of the Department of Engineering electronically submitted: (1) LFIF-2023-Foundry Street Resurfacing Improve-00024 application to NJDOT requesting grant funding in the amount of Two Million Two Hundred Nineteen Thousand Five Hundred Eighty-One Dollars and Zero Cents ($2,219,581.00) for the Foundry Street Resurfacing Improvement, with no City funds required; and

 

WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City is required to submit a resolution from the Municipal Council authorizing submission of the grant applications; and

 

WHEREAS, upon notification of the receipt of the grant award in connection with these applications, the Acting Director of the Department of Engineering desires to accept the grant award and execute a Grant Agreement governing said awards; and

 

WHEREAS, upon notification of the receipt of a grant award in connection with these applications, the Acting Director of the Department of Engineering shall submit a copy of the Grant Agreement to the Corporation Counsel and Business Administrator for review, approval, and signature.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to electronically submit: 1) LFIF-2023-Foundry Street Resurfacing Improve-00024 application to NJDOT requesting grant funding in the amount of Two Million Two Hundred Nineteen Thousand Five Hundred Eighty-One Dollars and Zero Cents ($2,219,581.00) from the FY2023 LFIF Grant Program for Foundry Street Resurfacing Improvements, with no City funds required (a copy of the applications are attached hereto and made a part hereof).

 

2.                     The Municipal Council hereby ratifies its authorization of these applications from the date of application submission to the date of adoption of this authorizing Resolution.

 

3.                     Upon notification of the receipt of one (1) or both grant awards in connection with these applications, the City hereby accepts the funding.

 

4.                     Upon notification of the receipt of a grant award in connection with these applications, the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with NJDOT to receive and expend grant funding for the Foundry Street Resurfacing Improvements.

 

5.                     Upon notification of the receipt of one (1) or both grant awards in connection with these applications, the Acting Director of the Department of Engineering shall submit a complete copy of the Grant Agreement and any associated documents, as well as a copy of the Certification of Funds for any required matching funds, to both the Corporation Counsel and Business Administrator for review, approval and signature.

 

6.                     No municipal funds are required for receipt or acceptance of this grant award.

 

7.                     The Acting Director of the Department of Engineering shall file a fully executed copy of the grant applications, the grant award letters, the Grant Agreement, and a copy of the Certification of Funds for any required matching funds in the Office of the City Clerk.

 

 

STATEMENT

 

This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to electronically submit an application for, accept, and enter into and execute a Grant Agreement for grant funding in the amount of $2,219,581.00 from NJDOT for the Foundry Street Resurfacing Improvements. No municipal funds are required.
