[WHEREAS, on July 21, 2016, on behalf of the City of Newark (the “City”), the Newark Community Economic Development Corporation (“NCEDC”), the then designee of the Mayor of the City of Newark, the Senior Vice President of Real Estate Development of the NCEDC submitted an application to the New Jersey Department of Environmental Protection, Office of Natural Resource Restoration (“NJDEP ONRR”) in solicitation of the Newark Bay Complex grant requesting grant funding of Seventeen Million Nine Hundred Sixty-Two Thousand Dollars and Zero Cents ($17,962,000.00) to develop public access on the Passaic River and Newark Bay Complex; and
WHEREAS, the City still desires to further the public interest by obtaining a grant from the state of New Jersey in the amount of approximately Seventeen Million Nine Hundred Sixty-Two Thousand Dollars and Zero Cents ($17,962,000.00) to fund a restoration grant for the Riverfront Park Expansion; and
WHEREAS, as a result of this application, the City has been awarded a grant in the amount of Seventeen Million Nine Hundred Sixty-Two Thousand Dollars and Zero Cents ($17,962,000.00) from the NJDEP ONRR to develop public access on the Passaic River and Newark Bay Complex, (primarily for the purchase of land that is located along the Passaic River and Newark Bay Complex); and
WHEREAS, the New Jersey Department of Environmental Protection has been released a grant up to Seventeen Million Nine Hundred Sixty-Two Thousand Dollars and Zero Cents ($17,962,000.00) to develop public access on the Passaic River and Newark Bay Complex from NJDEP ONRR for the period commencing March 22, 2017 and terminating on March 31, 2025; and
WHEREAS, the City requests authorization to execute Grant Agreement with NJDEP ONRR for the Riverfront Park Expansion Project and authorizes the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute said Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to submit an application to New Jersey Department of Environmental Protection, Office of Natural Resource Restoration requesting grant funding in the amount of Seventeen Million Nine Hundred Sixty-Two Thousand Dollars and Zero Cents ($17,962,000.00) from the Newark Bay Complex grant application to develop public access on the Passaic River and Newark Bay Complex with no City funds required (a copy of the application is attached hereto and made a part hereof).
2. Authorizes the execution of the Grant Agreement with NJDEP ONRR for the Riverfront Park and Expansion Project.
3. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing Resolution.
4. This Municipal Council does hereby authorize and agree to match fifty percent (50%) of the total project amount, in in-kind services, in compliance with the match requirements of the Agreement.
5. The City of Newark agrees to comply with all applicable Federal, State, and municipal laws, rules and regulations in its performance pursuant to the Agreement.
6. A certified copy of this Resolution to be sent to NJDEP ONRR.
7. The Newark Bay Complex grant award in the amount of Seventeen Million Nine Hundred Sixty-Two Thousand Dollars and Zero Cents ($17,962,000.00) from NJDEP ONRR is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
8. The Agreement between the City and NJDEP ONRR is hereby ratified from March 22, 2017 to the date of adoption of this authorizing Resolution.
STATEMENT
This Resolution ratifies and authorizes the actions taken by the Deputy Mayor/Director of the Department of Economic Housing and Development and/or the NCEDC designee to submit an application for the Newark Bay Complex Grant funding from NJDEP ONRR to purchase land and develop public access on the Passaic River, and Newark Bay Complex, and furthermore, ratifies and authorizes Mayor of the City of Newark and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute an Agreement with and accept grant funds in the amount of $17,962,000.00 from NJDEP ONRR to acquire land and develop public access on the Passaic River, and Newark Bay Complex for the period commencing March 22, 2017 and terminating March 31, 2025. Matching grant funds in the amount of $25,000,000.00 shall be provided from the municipal budget.
