                      WHEREAS, the City of Newark (the “City”) in furtherance of its goals to search for lower costs, greater efficiency and improve product quality wishes to enter into an Inter-local Contract for Cooperative Purchasing; and

 

                     WHEREAS, cooperative purchasing is an inclusive term used to describe all purchasing systems where two (2) or more local contracting units join together for the provision or performance of goods or services as provided for by the Local Public Contracts Law; and

 

                     WHEREAS, the purchase of goods or services by two (2) or more contracting units increases proportionate saving in costs gained by an increased level of production; and 

 

                     WHEREAS, the City of Newark, a sub-political body of the State of New Jersey is permitted to join Cooperative Purchasing Programs, pursuant to N.J.S.A. 52:34-6.2(b)(3); and

 

                     WHEREAS, the Minnesota Multistate Contracting Alliance for Pharmacy (“MMCAP Infuse”) Cooperative Purchasing Program is a nationally recognized and accepted cooperative purchasing organization; and

 

                     WHEREAS, the MMCAP Infuse system was developed for the purpose of utilizing a competitive bidding process to make the procurement process more efficient and provide cost savings to its members; and          

 

                     WHEREAS, the MMCAP Infuse has offered the City of Newark and all its Departments the opportunity to participate in the Cooperative Purchasing System for the procurement of goods and services; and 

 

                     WHEREAS, the City of Newark desires to join the MMCAP Infuse to purchase goods and/or services, to make the procurement process more efficient and to provide cost savings to the City overall; and

 

                     WHEREAS, the City of Newark has deemed it to be in the best interest of the department and the City to pursue membership in Membership in Minnesota Multistate Contracting Alliance for Pharmacy Purchasing Program to maximize their buying power in the acquisition of healthcare goods and services.               

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designees, the Business Administrator and/or the Qualified Purchasing Agent, are hereby authorized to join the Minnesota Multistate Contracting Alliance for Pharmacy Cooperative Purchasing Program to procure goods and services available through the MMCAP Infuse National Cooperative Purchasing Program.

 

2.                     The Division of Central Purchasing through the Qualified Purchasing Agent shall ensure that the goods and/or services procured through the system comply with applicable laws of the State of New Jersey, Local Public Contract Law N.J.S.A. 40A:11-1et seq. and all other provisions of the revised statutes of the State of New Jersey.

 

3.                     Upon approval of the above membership in the Minnesota Multistate Contracting Alliance for Pharmacy (MMCAP) purchasing program, the City may elect to make purchases and/or contract for services through MCCAP, however, before the City may purchase and/or contract for services through MMCAP, the City must receive approval from the Municipal Council.

 

 

STATEMENT

 

This Resolution authorizes the City of Newark through the Qualified Purchasing Agent to join the Minnesota Multistate Contracting Alliance for Pharmacy National Cooperative Purchasing Program, to allow the City to procure goods and or services and to maximize their procurement dollars as long the membership is active.
