The Project is #0714-21-UPG; 0714-21-01,1 Broadway Park located between Broadway and Oraton Street (Block 729, Lots 21, 24, 26, 75, 77, 79, 80, 81, 83, 84, and 107).

WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (the “State”), provides loans and/or grants to municipal and county governments and grants to non-profit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and

 

WHEREAS, the City of Newark (the “City”) desires to further the public interest by obtaining a Green Acres Grant of One Million and Two Hundred Thousand Dollars and Zero Cents ($1,200,000.00) and an Urban Parks Grant of $500,000.00 from the State to fund the following project(s) #0714-21-UPG; 0714-21-011-Broadway Park located between Broadway and Oraton Street, Blocks 729 Lots 21, 24, 26, 75, 77, 79, 80, 81, 83, and 84; and

 

WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; and

 

WHEREAS, the applicant is willing to use the State’s funds in accordance with such rules, regulations and applicable statutes, and is willing to enter into an agreement with the State for the above named project; and

 

WHEREAS, Municipal Council adopted Resolution 7R11-b(S) adopted on July 14, 2021, which authorized the City’s Director of the Department of Recreation, Cultural Affairs and Senior Services submitted an application to the State for financial assistance to be used towards the Broadway Park Project and;

 

WHEREAS, the State has found it to be in conformity with the scope and intent of the Green Acres Program and has approved the City’s request and has awarded a grant award in the amount of One Million Two Hundred Thousand Dollars and Zero Cents ($1,200,00.00) and an Urban Park Grant in the amount of Five Hundred Thousand Dollars and Zero Cents ($500,000.00) totaling One Million Seven Hundred Thousand Dollars and Zero Cents ($1,700,000.00) to be used towards the Broadway Park Project; and

 

WHEREAS, the City agrees to use the State’s funds in accordance with the Outdoor Recreation Legacy Partnership Program terms and conditions, as well as the State’s rules, regulations, and applicable statues and is willing to enter into an Agreement with the State for the Project - #0714-21-UPG; 0714-21-011 Broadway Park.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT: 

 

1.                     The Mayor of the City of Newark and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services are hereby authorized to accept grant funds from the New Jersey Department of Environmental Protection, Green Acres Program to fund Project - #0714-21-UPG; 0714-21-011 Broadway Park located at between Broadway and Oraton Street, Newark, New Jersey 07104, Block 729 Lots 21, 24, 26, 75, 77, 79, 80, 81, 83, and 84, (the “Broadway Park Project”).

 

2.                     The Green Acres Grant award in the amount of One Million Two Hundred Thousand Dollars and Zero Cents ($1,200,00.00) and the Urban Park Grant in the amount of Five Hundred Thousand Dollars and Zero Cents ($500,000.00) totaling One Million Seven Hundred Thousand Dollars and Zero Cents ($1,700,000.00) from the State’s Green Acres Program is hereby accepted.

 

3.                     The City has already satisfied its matching share of the project in the amount of Five Hundred Thousand Dollars and Zero Cents ($500,000.00).

 

4.                     In the event the State’s funds are less than the total project cost specified above, the applicant has the balance of funding necessary to complete the project.

 

5.                     The applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project.

 

6.                     The Director of the Department of the Department of Recreation, Cultural Affairs and Senior Services shall file a fully-executed copy of the grant application to the State, the grant award letter, and the Amended Green Acres Project Agreement in the Office of City Clerk.

 

 

STATEMENT

 

                     This Resolution authorizes the Mayor of the City of Newark and/or the Director of the Department of Recreation, Cultural Affairs and Senior Services to enter into and execute an Amended Green Acres Project Agreement with and accept grant funds in the amount of $1,700,000.00 and Urban Parks Grant of $500,000.00 from the State’s Green Acres Program to be used towards the Broadway Park Project for the grant period terminating two (2) years from the date the Amended Green Acres Project Agreement is executed by the State.  The City has already satisfied its matching share of the project in the amount of $500,000.00.
