 WHEREAS, on August 3, 2022, through Resolution 7R2-j, the Municipal Council ratified and authorized the Mayor of the City of Newark and/or his designee(s), the Deputy Mayor of Workforce Development and/or the Director of One Stop Career Center/NewarkWORKS, to accept the following: Workforce Innovation and Opportunity Act (WIOA) funds in the amounts of $2,503,478.00 (WIOA Youth), $2,343,637.00 (WIOA Adult) and $808,458.00 (WIOA Dislocated Worker) for a combined total of $5,655,573.00 from the State of New Jersey Department of Labor and Workforce Development, which eighty (80%) percent of the funds must be obligated by June 30, 2023 and fully expended no later than June 30, 2024; and

 

WHEREAS, there exists a need for NewarkWORKS to enter into a contract to provide for employment training services to youth in the City of Newark; and

 

WHEREAS, N.J.S.A. 40A:11-4.1(b)(2) provides for the use of competitive contracting  for the operation, management or administration of recreation or social services facilities or programs; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-4.1(b)(2), on July 13, 2022, Newark Workforce Development through the Purchasing Agent, QPA, for the City of Newark publicly advertised Request For Proposals (RFPs) for Employment Training Services (Youth); and

 

WHEREAS, the Division of Central Purchasing published the Request for Proposal on the City of Newark’s electronic procurement portal to provide a broader access and download capability to potential bidders; and

 

WHEREAS, twenty-three (23) bid proposal packages were downloaded via the electronic procurement portal; and

 

WHEREAS, on September 1, 2022, the Purchasing Agent, QPA, received proposals from four (4) vendors and publicly opened and read aloud the names and addresses of the vendors who submitted a proposal package on the advertised deadline; and

 

WHEREAS, a three (3)-member evaluation committee was formed to review the proposals submitted by the four (4) vendors and make a recommendation, as outlined in the specifications; and

 

WHEREAS, the Purchasing Agent, QPA, obtained signed no conflict letters from the members of the evaluation committee (copies of which are attached hereto and made a part hereof) before releasing the RFP responses to the evaluators via the electronic procurement portal; and

 

WHEREAS, the evaluation committee evaluated the four (4) responses and made its recommendation to the Purchasing Agent, QPA, for a dual award finding that from the proposals received, the proposals from 1. Goode Education Group LLC, 26 Park Street Suite 2210, Montclair, New Jersey 07042 and 2. Junior Entrepreneurs Club Training Program, Inc., 569 Dr. Martin Luther King Jr. Blvd, Newark, New Jersey 07102 are the most advantageous and in the best interest of the City of Newark, cost and other factors considered, pursuant to the criteria listed in the RFP; and

 

WHEREAS, the Purchasing Agent, QPA, concurs with the evaluation committee’s recommendation that multiple contract awards be made to 1. Goode Education Group LLC, 26 Park Street Suite 2210, Montclair, New Jersey 07042 and 2. Junior Entrepreneurs Club Training Program, Inc., 569 Dr. Martin Luther King Jr. Blvd, Newark, New Jersey 07102; and

 

WHEREAS, these contracts are being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5 and the City’s Pay-to-Play Ordinance, R.O. 2:4-22C.1; and

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designees, the Business Administrator and/or the Purchasing Agent, QPA, are hereby authorized to enter into contracts with 1. Goode Education Group LLC, 26 Park Street Suite 2210, Montclair, New Jersey 07042 and 2. Junior Entrepreneurs Club Training Program, Inc., 569 Dr. Martin Luther King Jr. Blvd, Newark, New Jersey 07102 to provide Employment Training Services (Youth) in the manner and amounts identified by the evaluation committee based on the program elements, experience, past performance, program implementation, proposed contract cost, alignment with the goals of Workforce Development and being the qualified responsive and responsible respondents. The contract term will be established for a period not to exceed twenty-four (24) consecutive months after Municipal Council adoption contingent on WIOA funding.

 

2.                      Goode Education Group LLC, 26 Park Street Suite 2210, Montclair, New Jersey 07042 contract amount shall not exceed Forty Thousand Dollars and Zero Cents ($40,000.00) and Junior Entrepreneurs Club Training Program, Inc., 569 Dr. Martin Luther King Jr. Blvd, Newark, New Jersey 07102 contract amount shall not exceed Two Hundred Thousand Three Hundred and Zero Cents ($200,000.00) for a total amount not to exceed Two Hundred Forty Thousand Dollars and Zero Cents ($240,000.00).

 

3.                     The Municipal Council of the City of Newark hereby authorizes and ratifies the use of competitive contracting to provide for employment training services for youth, from July 13, 2022, to the date of adoption of this resolution.

 

4.                     There shall be no amendment or change of this contract without the approval of the Municipal Council by resolution.

 

5.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2022 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C. 5:30-5.5(d).

 

6.                     This is an open-ended contract to be used as needed during the term of the contract. Thus, for any and all expenditures against this contract a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from Newark Workforce Innovation Opportunity Act Grant NW051-G22-M22E0-72060. This contract shall not exceed Two Hundred Forty Thousand Dollars and Zero Cents ($240,000.00) for twenty-four (24) consecutive months commencing upon adoption of this resolution.

 

7.                     The Purchasing Agent, QPA, shall file a duly executed copy of the contract in the Office of the City Clerk.

 

8.                     If required by State law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

This Resolution ratifies and authorizes the use of competitive contracting pursuant to N.J.S.A. 40A:11-4.1(b)(2)  and further authorizes the Mayor and/or his designees, the Business Administrator and/or the Purchasing Agent, QPA, to award contracts to 1. Goode Education Group LLC, 26 Park Street Suite 2210, Montclair, New Jersey 07042 and 2. Junior Entrepreneurs Club Training Program, Inc., 569 Dr. Martin Luther King Jr. Blvd, Newark, New Jersey 07102 to provide Employment Training Services (Youth) at an amount not to exceed Two Hundred Forty Thousand Dollars and Zero Cents ($240,000.00) for twenty-four (24) consecutive months commencing upon adoption of this resolution.
