AN ORDINANCE AMENDING TITLE 5, AMUSEMENT AND AMUSEMENT BUSINESSES, CHAPTER 5, MISCELLANEOUS AMUSEMENT BUSINESSES, SECTION 4-8(A), BUSINESS HOURS, AND CREATING CHAPTER 14, MANDATE TO HIRE SPECIAL POLICE OFFICERS, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, TO REQUIRE THE HIRING OF SPECIAL POLICE DURING SPECIFIED BUSINESS HOURS.

NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

Section 1. Title 5, Amusement and Amusement Businesses, Chapter 5, Miscellaneous Amusement Businesses, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, is amending Section 4-8(a), Business Hours.

 

§ 5:4-8(a) BUSINESS HOURS.

 

a.                     Every place of business licensed under this chapter, except as otherwise provided in paragraphs b and c of this Section, shall close at 1:00 a.m. every day except Saturday Sunday, on which day they shall close at midnight. All such places shall then remain closed until 7:00 a.m. 

Section 2.   Title 5, Amusement and Amusement Businesses, Chapter 5, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, by adding thereto Section 14: Mandate to Hire Special Police Offers.

 

§ 5:14 MANDATE TO HIRE SPECIAL POLICE OFFICERS.

 

a.                     Any place of business licensed under this Chapter which offers any entertainment, including, but not limited to, live music, disc jockey, and the sale and/or service of any alcoholic beverage, if open at any time after 11:00 p.m. on any day, and has an occupancy of fifty (50) or more occupants, shall have Special Police Officers on premise from 11:00 p.m. through closing.

1.                     Closing shall be defined as the end of a business or commercial establishment’s day, pursuant to State Statute and/or City Ordinance.

b.                     Penalty:

1.                     Any person who violates any provision of this Section shall be penalized and fined in the following manner:

 

i.                     A fine of $1,000.00 will be imposed per offense; and

 

ii.                     A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

 

Section 3. Any existing ordinance, or part thereof, inconsistent with this Ordinance is hereby repealed to the extent of such inconsistency.

 

Section 4.  If any Section, paragraph, subparagraph, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the specific Section, paragraph, subparagraph, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective.

 

Section 5.  This Ordinance shall take effect upon final passage and publications in accordance with the laws of the State of New Jersey.

 

 

STATEMENT

 

This Ordinance amends Title 5, Amusement and Amusement Businesses, Chapter 5, Miscellaneous Amusement Businesses, Section 4-8(a) Business Hours, and establishes Title 5, Amusement and Amusement Businesses, creating Chapter 14, Mandate to Hire Special Police Officers, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented to require the hiring of special police during specified business hours.
