Original Resolution 7R1-e was adopted on September 21, 2022, authorizing a contract with F. Basso, Jr Rubbish Removal, Inc., to provide recycling, curbside collection for an amount not to exceed $3,696,000.00, for a period not to exceed twenty-four (24) consecutive months.

WHEREAS, Resolution 7R1-e adopted on September 21, 2022, by the Municipal Council authorized the Purchasing Agent, QPA (the “QPA”), to enter into and execute a contract with F. Basso, Jr Rubbish Removal, Inc., 55-93 South 20th Street, Irvington, New Jersey 07111 (the “Contractor”), to provide Recycling, Curbside Collection in the amount not to exceed Three Million Six Hundred Ninety-Six Thousand Dollars and Zero Cents ($3,696,000.00), for a period not to exceed twenty-four (24) consecutive months, pursuant to N.J.S.A. 40A:11-15; and
WHEREAS, pursuant to the terms of the Contract, specifically Section 3.31(H) - Termination of Contract, the City of Newark (the “City”) wishes to terminate the Contract for convenience by providing sixty (60) calendar days advanced notice to the Contractor; and
WHEREAS, accordingly the QPA issued Notice to Terminate to the Contractor on January 31, 2023 (the “Notice”), and said Notice is made a part hereof; and
WHEREAS, sixty (60) days have passed since the issuance of the Notice, and the Department of Administration, Division of Central Purchasing wishes to rescind Resolution 7R1-e adopted on September 21, 2022 and terminate the Contract with the Contractor effective April 1, 2023.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R1-e adopted on September 21, 2022 by the Municipal Council awarding a Contract to F. Basso, Jr Rubbish Removal, Inc., 55-93 South 20th Street, Irvington, New Jersey 07111 (the “Contractor”), in an amount not to exceed Three Million Six Hundred Ninety-Six Thousand Dollars and Zero Cents ($3,696,000.00), for a period not to exceed twenty-four (24) consecutive months, pursuant to N.J.S.A. 40A:11-15, is hereby rescinded and the Contract with the Contractor is null and void.
STATEMENT
This Resolution rescinds Resolution 7R1-e adopted on September 21, 2022, for the award of a Contract to F. Basso, Jr Rubbish Removal, Inc., 55-93 South 20th Street, Irvington, New Jersey 07111, to provide Recycling, Curbside Collection for the Department of Public Works, Division of Public Buildings, in an amount not to exceed $3,696,000.00, for a period not to exceed twenty-four (24) consecutive months, pursuant to N.J.S.A. 40A:11-15, due to the City’s desire to terminate the contract for convenience.
