2 AN ORDINANCE APPROVING AN AMENDMENT
3 TO THE URBAN RENEWAL PLAN FOR THE
4 FAIRMOUNT URBAN RENEWAL PROJECT,
5 N.J.R 72 (9TH AMENDMENT)

8 WHEREAS, it has heretofore been found and determined by virtue
9 of Municipal Council Resolution 7Rj adopted May 20, 1964 that the to Project area known as the Faifmount Urban Renewal Pioject
11 blighted area under Chapter 187 of the Laws of the State of New
12 Jersey, 1949, as amended; and
13
14 WHEREAS, the Municipal Council of the City of Newark did
15 approve the original Urban Renewal Plan by Resolution 7RBL on
16 August 4, 1965; and
17
18 WHEREAS, the Municipal Council of the City of Newark has
19 heretofore by Resolution 7RBL adopted August 4, 1965; 7RBD adopted
20 March 20, 1968; 7RBD adopted April 16, 1969; 7RV adopted November 24, 211970; 7RCE adopted March 21, 1973; 7R-g adopted September 5, 1973; 227RBT adopted March 5, 1975; Ordinances 7S & F-d adopted April 18, 231979; 7S & FF adopted November 3, 1982; approved Urban Renewal Plan
24 Amendments for the Fairmount Urban Renewal Plan (N.J.R-72); and

26 WHEREAS, it is necessary to further amend said Urban Renewal Plan
27 such amendment to consist of: (1) Land formerly designated for mintensive business use, bounded by Morris Avenue on the west, Cabinet nStreet on the north, vacated Newton,,Street en�the east, and Twelfth HAvenue on the south, will be changed in land use to Residential
31 Medium Density. This change requires an amendment of Urban Renewal
32 Plan Map two (2) with regard to this change in land use. (2) Certain
33 specific environmental and building controls were eliminated and from
34 the text of this plan. All developments in this project area are
35 under controls of all such applicable municipal environmental and
36 building controls. Thus, a redundancy has been eliminated.

38 WHEREAS, said Urban Renewal Plan complies with the requirements
39 of all applicable state and federal statutes and regulations
40 promulgated thereunder; and
41
42 WHEREAS, the Central Planning Board of the City of Newark has
43 submitted to the Municipal Council its recommendation respecting the
44 amended Urban Renewal Plan for the Project Area and the Municipal
45 Council has duly considered the recommendation of the Planning Board;
46 and
47
48 WHEREAS, the Municipal Council is cognizant of the conditions
49 that are imposed in the undertaken and carrying out of Urban Renewal
50 Projects with financial assistance under Title I, including those
51 prohibiting discrimination because of r;ace, color, creed or national
52 origin; and

1 WHEREAS,it is not necessary that the Municipal Council take
2appropriate official action respecting the relcation program and the
-
3Urban Renewal Plan for the Project, in conformity with a contract for 4financial assistance between the Housing Authority and the United 5States of America, acting by and through the Secretary of the 6Department of Housing and Urban Development.

8 NOW THEREFORE BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE
9CITY OF NEWARK, NEW JERSEY:

11 1. That it is hereby found and determined that the amended
12Urban Renewal Plan N.J.R-72 for the Fairmount Urban Renewal
13 Project Area conforms to the general plan of the locality.

15 2. That it is hereby found and determined that the amended
16Urban Renewal Plan indicates proposed land uses and building
17 requirements in the area, and its relationship to definite local
18 objectives as to appropriate land uses, density of population and 19 improved traffic, public transportation, public utilities,
2orecreational and community facilities and other public improvements, 2lwith special consideration for the health, safety and welfare of
22 children residing in the general vicinity of the site covered by the
23 plan.

25 3. That the amended Urban Renewal Plan provides for the location
26of persons living in the project Area and that the proper relocation 27of the individuals and families displaced in carrying out the Project 28in decent, safe, and sanitary dwellings in conformity with acceptable 29 standards is feasible and can be reasonably and timely effected to 3opermit the proper prosecution and completion of the Project; and that 31such dwellings or dwelling units available or to be made available to 32such displaced individuals and families are at least equal in number 33to the number of displaced individuals and families, are not 34generally less desirable in regard to public utilities and public and 35commercial facilities than the dwellings of the displaced
36individuals and families are reasonable accessible to their places of 37employment.

39 4. That it is hereby found and determined that the objective of
othe amended Urban Renewal Plan cannot be achieved through 41rehabilitation of the Project Area.

43 5. That it is hereby found and determined that amended Urban
44Renewal Plan for the Urban Renewal Area will afford maximum 45opportunity, consistent with the sound needs of the locality as a 46whole, for the Urban Renewal of the areas by private enterprise.

48 6. That in order to facilitate the implementation of the
49amended Urban Renewal Plan hereby approved it is found and determined 50that certain official action must be taken by the Municipal Council 51of the City of Newark, and accordingly, this Municipal Council hereby; 52(a) Pledges its cooperation in helping to carry out such Urban Renewal 53Plan; (b) Requests the various officials, departments, boards and 54agencies of the locality having administrative responsibilities in 55the premises likewise to cooperate to such end and to exercise their 56respective functions and powers in a manner consistent with said 57Urban Renewal Plan; and (c) Stands ready to consider and take 58appropriate action upon proposals and measures designed to implement 59said Urban Renewal Plan.

7. That it is hereby found and determined that the financial
2 aid provided and to be provided pursuant to contracts for federal
3 financial assistance pertaining to the Project is necessary to enable
4 the project to be undertaken in accordance with the Urban Renewal
5 Plan for the Project Area.

7 8. That the Urban Renewal Plan for the Area having been duly
8 reviewed and considered, is hereby approved, and the City Clerk be
9 and is hereby directed to file said copy of the Urban Renewal Plan
10 with the minutes of this meeting.

12 9. That this Ordinance shall take effect upon final passage and
13 publication in accordance with law.
