WHEREAS, on August 5, 2015, the Municipal Council adopted Resolution 7R4b authorizing the Director of the Department of Engineering to enter into and execute Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, with EIC Inspection Agency Corporation, 3705/3707 Kennedy Boulevard, Jersey City, New Jersey 07307, for a term of one (1) year from July 6, 2015 to July 5, 2016, with two (2) one (1) year options to extend; and
WHEREAS, on July 12, 2017, the Municipal Council adopted Resolution 7R3b(as) authorizing Amendment #1 extending the term of Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, with EIC Inspection Agency Corporation, for an additional one year through July 5, 2017; and
WHEREAS, the Director of the Department of Engineering believes that the above services are being performed in an effective and efficient manner and desires to grant EIC Inspection Agency Corporation’s request to exercise its second and final option to extend its contract for an additional one (1) year period; and
WHEREAS, the Director of the Department of Engineering desires to enter into Amendment #2 to Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, to extend the contract term for an additional one year, through July 5, 2018, at no cost to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee and the Director of the Department Engineering, are hereby authorized to execute Amendment #2 to Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, with EIC Inspection Agency Corporation, 3705/3707 Kennedy Boulevard, Jersey City, New Jersey 07307, to extend the term of the contract for one year, through July 5, 2018, pursuant to N.J.S.A. 40A:11-15, because the services are being performed by EIC Agency Corporation in an effective and efficient manner at no additional cost to the City.
2. The Amendment #2 to Contract #02-2015 is ratified from July 6, 2017 until the date of adoption of this resolution.
3. All other terms and conditions of Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, as amended, shall apply and remain in full force and effect.
4. No Certification of Funds is required to execute Amendment #2 since the funds to pay EIC Inspection Agency Corporation as the on-site Elevator Sub-Code Official will be generated from the fees collected for elevator inspections.
5. No further extensions to the term of this amended contract shall be permitted.
6. A fully executed copy of this Amendment #2 shall be filed in the Office of the City Clerk by the Director of the Department of Engineering or his designee.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to execute Amendment #2 to Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, with EIC Inspection Agency Corporation, 3705/3707 Kennedy Boulevard, Jersey City, New Jersey 07307, to extend the term of the contract for one (1) year, through July 5, 2018, pursuant to N.J.S.A. 40A:11-15, at no additional cost to the City.
