WHEREAS, on September 8, 2016 through Resolution 7R4-D, the Newark Municipal Council authorized the Mayor and the Director of the Department of Engineering to accept the bid proposal submitted by the lowest responsible bidder, Statewide Striping Corporation, 499 Pomeroy Road, Parsippany, New Jersey 07054 and execute Contract No. 02-2016, Installation of Pavement Markings on Various Streets in the City of Newark, for a total bid amount of $150,225.00; and
WHEREAS, the City’s public bid contained a contract term of 180 consecutive calendar days from the issuance of a written Notice to Proceed by the City; and
WHEREAS, Section 5 of Resolution 7R4-D adopted September 8, 2016, mistakenly contained a typographical error in the term of Contract No. 02-2016, which authorized the contract to be completed within a period of 365 consecutive calendar days from the issue of a “Notice to Proceed” by the Director of the Department of Engineering; and
WHEREAS, Article 3.1 of Contract No. 02-2016 authorized by Resolution 7R4-D adopted September 8, 2016, also contained a typographical error in the term indicating that the contract term shall be 180 calendar days from Substantial Completion and 180 calendar days from Final Completion, commencing on a date to be specified in a written Notice to Proceed of the Owner; and
WHEREAS, the Department of Engineering wishes to correct the typographical errors in Resolution 7R4-D, adopted September 8, 2016, and Article 3.1 of Contract No. 02-2016, so that they agree with the term that was set forth in the City’s Public Bid.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R4-D adopted September 8, 2016, is hereby amended to correct several typographical errors, so that it agrees with the term that was set forth in the City’s Public Bid, specifically:
a. the contract period contained in the title page of the Resolution 7R4-D adopted September 8, 2016, shall read as follows: “180 days from the issuance of a Notice to Proceed by the Director of the Department of Engineering.”
b. Section 5 of Resolution 7R4-D adopted September 8, 2016 shall read as follows: “the contract is to be completed within a period of 180 consecutive calendar days from the issuance of a Notice to Proceed by the Director of the Department of Engineering.”
c. Article 3.1 of Contract No. 02-2016 shall read as follows: “the contract is to be completed within a period of 180 consecutive calendar days from the issuance of a Notice to Proceed by the Director of the Department of Engineering.”
2. The correction to Contract No. 02-2016 is ratified from September 8, 2016 until the date of adoption of this authorizing resolution.
3. A fully executed copy of the corrected contract and this corrective resolution shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
STATEMENT
Passage of this amending Resolution will correct a typographical error to the term of the contract contained in Section 5 of Resolution 7R4-D adopted September 8, 2016, as well as correct a typographical error to the term of the contract contained in Article 3.1 of Contract No. 02-2016, authorized by Resolution 7R4-D September 8, 2016, so that it agrees with the term that was set forth in the City’s Public Bid. The correction to Contract No. 02-2016 is ratified from September 8, 2016 until the date of adoption of this authorizing resolution. .
