WHEREAS, the City of Newark, Department of Engineering, Division of Traffic and Signals (the "City"), advertised for receipt of bids on April 11, 2019, for Contract No. 2018-01, Various Streets-2017 Newark (15 Locations) MA-17; and
WHEREAS, on April 11, 2019, the City provided vendors who picked up a bid with Addendum #1; and
WHEREAS, on April 25, 2019, the City received two (2) bids for Contract No. 2018-01, Various Streets -2017 Newark (15 Locations) MA-17 in the City of Newark; and
WHEREAS, the City rejected all of the bids as non-responsive since the bidders failed to comply with the bid specifications, pursuant to the requirements set forth in N.J.S.A. 40A:11-13.2; and
WHEREAS, the City, re-advertised for receipt of bids on May 2, 2019, for Contract No. 2018-01R, Various Streets-2017 Newark (15 Locations) MA-17; and
WHEREAS, on May 14, 2019, the City received two (2) bids for Contract No. 2018-01R, Various Streets-2017 Newark (15 Locations) MA-17, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, based on a review of the bids, the Director of the Department of Engineering, desires to accept the bid proposal submitted by the lowest responsible bidder, JA Alexander, Inc., 130 JFK Drive North, Bloomfield, New Jersey 07003, and execute Contract No. 2018-01R, Various Streets-2017 Newark (15 Locations) MA-17, for the total bid amount not to exceed Two Million Two Hundred Twenty-Seven Thousand Eight Hundred Thirty-Three Dollars and Forty- Six Cents ($2,227,833.46).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized, on behalf of the City of Newark, to accept the bid proposal submitted by the lowest responsible bidder, JA Alexander, Inc., 130 JFK Drive North, Bloomfield, New Jersey 07003, and execute Contract No. 2018-01R, Various Streets-2017 Newark (15 Locations) MA-17 in the City of Newark, for the total bid amount not to exceed Two Million Two Hundred Twenty-Seven Thousand Eight Hundred Thirty-Three Dollars and Forty-Six Cents ($2,227,833.46).
2. Attached hereto is a Certification of Funds from the Director of Finance, which states that funds for the entire contract are available in the amount of $699,736.00 in the 2019 Budget under Business Unit: NW011, Department ID: 110, Division: 1107, Account#: 71930, Budget Year: B2019. In the 2019 Budget, $198,363.46 under Business Unit: NW026, Account #: 38750, Budget Year: B2019 and, $1,329,734.00 are available in the 2018 Budget under Business Unit: NW051, Department ID: G18, Division: E18A0, Account #: 71930, Budget Year: B2018. The Certification shall be filed along with the original resolution in the Office of the City Clerk.
3. No changes to this contract are allowed without prior Municipal Council approval.
4. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
5. This contract is to be completed within a period of 365 consecutive calendar days from the issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
6. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
