Contract #02-2015 Third Party Elevator Inspections and Plan Review Services

WHEREAS, provisions of N.J.A.C. 5:23-4.12 authorizes the establishment of private on-site inspection and plan review agencies for the purpose of contracting with municipalities in order to act in the place of an Elevator Sub-Code Official; and
WHEREAS, the City of Newark desires to appoint a private on-site inspection agency to act in the capacity of an Elevator Sub-Code Official; and
WHEREAS, on April 23, 2015, the Department of Engineering, City of Newark, consistent with the Local Public Contracts Law, N.J.A.C. 40A:11-1, et seq., N.J.A.C. 52-27D-124.3 et seq., and the Fair and Open Process of the State of New Jersey Pay-to-Play Law, N.J.S.A. 19:44A-20.5 et seq., advertised for the receipt of Request for Proposals (RFP) for Contract #02-2015 Third Party Elevator Inspections & Plan Review Services (under the State of New Jersey Uniform Construction Code Rules and Regulations); and
WHEREAS, two (2) firms picked up the RFP Packages; and
WHEREAS, on May 13, 2015, scheduled date for the public opening of bids, one (1) bid was received; and
WHEREAS, after a review of the one (1) bid received by the Director of the Department of Engineering and the Construction Official of the City of Newark’s Uniform Construction Code Office, it was decided that it is in the best interest of the City of Newark, to accept the proposal submitted by EIC Inspection Agency Corporation, 3705/3707 Kennedy Boulevard, Jersey City, New Jersey 07307; and
WHEREAS, the City of Newark desires to execute Contract #02-2015 Third Party Elevator Inspection and Plan Review Services, with EIC Inspection Agency Corporation, 3705/3707 Kennedy Boulevard, Jersey City, New Jersey 07307; to function as Elevator Sub-Code Official for ninety percent (90%) of the listed fee schedule as promulgated by the State of New Jersey, Uniform Construction Code, N.J.A.C. 5:23-12.6; plus forty percent (40%) of Third Party Vendor fees to cover administrative fees in accordance with City of Newark Ordinance 7:2-3.5.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, is hereby authorized to accept the attached proposal dated May 13, 2015, and execute Contract #02-2015 Third Party Elevator Inspections & Plan Review Services with EIC Inspection Agency Corporation, 3705/3707 Kennedy Boulevard, Jersey City, New Jersey 07307 to function as Elevator Sub-Code Official.
2. This contract shall become effective on July 6, 2015, for a period of one (1) year, with two (2) one (1) year options to extend.
3. EIC Inspection Agency Corporation, 3705/3707 Kenney Boulevard, Jersey City, New Jersey 07307, will adhere to and comply with all the duties and responsibilities enumerated in N.J.A.C. 5:23-4.14 and all related Local Performance Standards.
4. The fee collected for elevator inspections shall be ninety percent (90%) of the listed fee schedule as promulgated by the State of New Jersey, Uniform Construction Code, N.J.A.C. 5:23-12.6; plus forty percent (40%) of Third Party Vendor fees to cover administrative fees in accordance with City of Newark Ordinance 7:2-3.5
5. The Department of Engineering through its Construction Code Official is hereby authorized to oversee the work of the on-side Elevator Sub-Code Official and arrange for the deposit of the City’s share of the elevator inspection fees into the “Elevator Inspection Trust Fund.” The authorization to continue the Elevator Inspection Trust Fund shall conform to all State of New Jersey statues and regulations presently in force, or to be amended in the future
6. This Agreement is hereby ratified from July 6, 2015 through the date of adoption of this authorizing resolution.
7. No Certification of Funds is required for this contract since the funds to pay the private on-site inspection agency to serve as the on-site Elevator Sub-Code Official will be generated from the fees collected for elevator inspections. No fees need to be paid to the agency if an inspection does not take place, and no fees are generated.
8. This contract is being awarded pursuant to the fair and open procedures of the State of New Jersey Pay-to-Play Law N.J.S.A. 19:44A-20.5 and pursuant to the provisions of the Local Public Contracts Law N.J.S.A. 40A:1 1-5(l)(a)(i)).
9. A fully executed copy of this contract shall be filed in the Office of the City Clerk, as well as, forwarded to the Department of Community Affairs (DCA), State of New Jersey by the Director of the Department of Engineering.
STATEMENT
This resolution authorizes the Mayor and the Director of the Department of Engineering to accept the proposal and execute Contract #02-2015 Third Party Elevator Inspections & Plan Review Services and to function as Elevator Sub-Code Official with EIC Inspection Agency Corporation, 3705/3707 Kennedy Boulevard, Jersey City, New Jersey 07307 for a term of one (1) year from July 6, 2015 to July 5, 2016 with two (2) one (1) year options to extend. No municipal funds need to be expended for this resolution.
