WHEREAS, electronic ticketing (E-Ticketing) for traffic and other violations has been determined to increase the accuracy of summonses issued and reduce the time required to issue and process summonses; and
WHEREAS, the City of Newark desires to deploy certain technology in its police cars including cameras/microphones and license plate readers which are used during motor vehicle stops and traffic patrol activities; and
WHEREAS, the E-Ticketing Solution will permit officers to enter motor vehicle checks, motor vehicle accident reports and issue summonses, as required, in real time and reduce the amount of lost patrol time due to officers having to return to the precincts or headquarters to complete related administrative work; and
WHEREAS, the City of Newark desires to implement an E-Ticketing Solution that will interface seamlessly with the New Jersey Administrative Office of the Courts (AOC) and in turn will lessen the personnel needed to input the tickets at the Municipal Court; and
WHEREAS, the City of Newark issued a Request for Proposal for A TURNKEY Electronic Ticketing Solution to which Gold Type Business Machines, Inc. (GTBM) of Rutherford, New Jersey, was the sole respondent; and
WHEREAS, the Office of the Business Administrator and the Newark Police Department have determined this proposal to be fair and reasonable and will improve efficacy of the Newark Police Department and the Municipal Court in the issuance and processing of summonses for traffic and other violations; and
WHEREAS, E-ticketing Solution contract will be paid quarterly, from money collected from payment of tickets and will include costs of system maintenance and require no upfront capital expenditures; and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF The City Of NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator or the Director of the Police Department, be and are hereby authorized to enter into a contract with Gold Type Business Machines Inc., 351 Paterson Avenue, East Rutherford, NJ 07073 to provide a Turnkey Electronic Ticketing Solution, to the City of Newark, for a term of 5 years, in the amount of $1,505,920.00.
2. The term of the contract shall not exceed five (5) years and shall commence upon a notice to proceed issued by the Business Administrator or the Director of the Newark Police Department.
3. The cost of the contract will be paid from efficiencies and enhanced money collected from payment of tickets that will result in the Newark Police Department and the Municipal Court from the implementation of the Electronic Ticketing Solution.
4. There shall be no amendment or change of the contract without the approval of the Municipal Council by resolution.
5. A duly executed copy of the contract shall be forthwith filed in the Office of the City Clerk by the Director of the Department of Police and shall be made available for inspection.
6. The competitive contracting process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19-44A-20-5 as Fair and Open contract, and is in compliance with Executive Order MEO-07-0001, effective March 31, 2007.
7. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
8. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within 10 days of its passage.
9. If required by the State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes the Mayor and/or his designees, the Business Administrator or the Director of the Department of Police to enter into a contract with Gold Type Business Machines, Inc., 351 Paterson Avenue, East Rutherford, New Jersey 07073, for an Electronic Ticketing System for a term of five (5) years, in the amount of $1,505,920.00 with the funding for the contract derived efficiencies and enhanced money collected from payment of tickets realized from the system's implementation.
