WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of $327,344.66 for 2010 Clean Communities Program and no adequate provision has been made in the 2013 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose abovementioned; and
WHEREAS, funds administered from New Jersey Department of Environmental Protection Agency under the Clean Communities Act, N.J.S.A. 13:1E-217 et seq. ("Act"), established a grant fund, entitled the "Clean Communities Entitlement Program", the City of Newark accepted the 2010 Clean Communities Program funds in the amount of $327,344.66, to provide funds to supplement an existing litter reduction program and removal as well as the abatement of graffiti within the municipality; and
