WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $1,463,368.00 and $1,199,475.00, bringing the total program resources to $2,662,843.00 ($2,505,107.00 for construction and $157,736.00 for inspection services) for the Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park Project and no adequate provision has been made in the 2017 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A: 4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, by Resolutions 7R4-d dated September 2, 2015 and 7R4-a dated June 15, 2016, the City of Newark accepted funds from the New Jersey Department of Transportation (NJDOT), in the total amount of $2,662,843.00, to provide for construction of the Broad Street (2-Intersections FY-14), City of Newark, Essex County, STP-7628(103) CON Project (the "Project"); and
