Amending Constable Appointment due to the late receipt of the Constable Bond

WHEREAS, pursuant to N.J.S.A. 40A:9-120, Orlando Vick, Sr., of 729 South 20th Street, Newark, New Jersey 07103, was appointed as a Constable pursuant to Resolution 7R8-a adopted at the April 19, 2017 Regular Municipal Council Meeting; and
WHEREAS, pursuant to N.J.S.A. 40A:9-125, Orlando Vick, Sr., of 729 South 20th Street, Newark, New Jersey 07103, must give a bond, approved as to form, amount, and sufficiency by Acting Corporation Counsel and the Municipal Council; and
WHEREAS, pursuant to N.J.S.A. 40A:9-121, a Constable must qualify, within thirty (30) days of the initial adoption of the resolution of appointment, and shall hold office for a term of three (3) years; and
WHEREAS, the Municipal Council wishes to amend the term of appointment, in part due to overdue receipt of the required Bond, and wishes to have the Acting Corporation Counsel and the Municipal Council approve the form, amount, and sufficiency of the Constable Bond.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The term of the Constable appointment of Orlando Vick, Sr., of 729 South 20th Street, Newark, New Jersey 07103, is amended from April 19, 2017 to a period of three (3) years from the date of the Constable Bond to its expiration.
2. The Resolution 7R8-a, adopted on April 19, 2017, Regular Municipal Council Meeting is hereby amended accordingly.
3. The Constable Bond, in the amount of $1,000.00, issued to Orlando Vick, Sr., of 729 South 20th Street, Newark, New Jersey 07103, is approved as to form, amount, and sufficiency.
STATEMENT
This resolution hereby amends, authorizes, and approves as to form, amount, and sufficiency of the Constable Bond posted, for Orlando Vick, Sr., of 729 South 20th Street, Newark, New Jersey 07103, for a term of three (3) years from the date of the Constable Bond to its expiration.
