WHEREAS, the Clean Communities Program Act, N.J.S.A. 13:1E-213 et seq. ("Act"), established the "Clean Communities Entitlement Program" which is a non-lapsing revolving fund in the Department of Treasury, administered by the New Jersey Department of Environmental Protection ("NJDEP"), which is distributed as State aid to eligible municipalities for programs of litter pick up and removal as well as for abatement of graffiti; and

WHEREAS, the City of Newark is eligible, without application, to receive Clean Communities Program Funds, to be used for programs of litter pick up and removal as well as for abatement of graffiti throughout the City of Newark; and

WHEREAS, in order to receive Clean Communities Entitlement Program funds, municipalities are required to plan and implement a program which combines the elements of litter clean-up and removal, enforcement of litter related laws and ordinances, litter abatement, public information and education, and encourage the proper handling of solid waste; and
